Referred hereinafter as ‘ULcast.com’, ‘our’, ‘we’ and ‘us’; is an internet service provider. All customers under our service are subject to the terms and conditions described in this document. Under the terms of this agreement, signing up and/or using our service(s) in any form therefore declares that you have read, understand, and agree to the terms and conditions stated below. We reserves the right to make alterations to this document whenever we deem reasonable. It is the client’s sole responsibility to check this document for updates on a regular basis.

All material on this site, including but not limited to text, images, illustrations, code, scripts and audio clips/live audio is protected by copyrights which are owned and controlled by ULcast.com. Material from this website may not be copied, reproduced, republished, uploaded, posted, transmitted or distributed in any way, unless we give you the written permission to do so.
ULcast.com does not actively monitor stream contents and all content broadcast is the sole responsibility of the client.
We do not provide any form of legal cover to individuals or companies who utilize our services to distribute content with any copyright protection. Under no circumstances will ULcast.com be responsible for the behaviour of our clients or their users when found to be broadcasting protected content. All licensing, copyright and royalty issues are the sole responsibility of the individual clients and/or their production entities.
You may not use our services to distribute adult, racist or any other un-sociable material.
If contacted by an authority in the event of an illegal situation regarding any of the above, we will co-operate fully in any investigations they decide to make against clients found to be breaking the law.
ULcast.com will make every effort possible to ensure security of client’s data, however due to the large volume of media stored, our standard costs do not include backup of data, please contact us if you would like to arrange this at an extra cost. All data is stored at client’s own risk and we will assume no responsibility for any loss, damage or corruption of files hosted on our servers.
All live streaming plans purchased from ULcast.com are limited by bitrate (X kbps). If you choose to stream above the purchased bitrate on a live server, we reserve the right to suspend your account without warning, refund or explanation. For example, if your purchased plan is 64kbps you can broadcast at 24 or 32 or 64kbps but should not stream at 128kbps.
We will use reasonable efforts to provide the services 24 hours a day, 7 days a week for as long as you have paid for them. Sometimes, however, for a number of reasons, the services may be unavailable to you. You recognize and acknowledge that occasional unavailability of the services will occur. We make no representation or warranty that the services will be uninterrupted.
a. In the best interest of our subscribers, ULcast.com does not put a limit on the amount of listeners that may connect to the server, nor the amount of bandwidth a server may use.
b. The streaming server software requires a maximum number of listeners to be set. By default, your streaming account will be installed with a limit of 10,000 listeners. If needed, this may be increased at any time by contacting our customer support.
c. The unlimited service offered on our site is intended for personal sites, home businesses, and small businesses. This service is not intended for large enterprises, or other stations better suited to a dedicated server. Such big broadcasters may contact our support team for a customized dedicated server plan for neighbour less dedicated broadcasting.
ULcast.com offers an unlimited bandwidth policy by maintaining large ratios of bandwidth per customer. In rare cases, ULcast.com may find a customer to be using server resources (including bandwidth, memory, processing power and stored e-mail) to such an extent that he or she may jeopardize server performance and resources available for other customers. In such instances, ULcast.com reserves the right to suspend or terminate that account immediately. This policy is only implemented in extreme circumstances and is intended to prevent the misuse of the servers.
a. Refunds will only be issued at our sole discretion. Problems can typically be resolved by contacting customer support.
b. Any chargebacks or reversed transactions made on your payments will result in your account being immediately terminated.
a. We cannot assure that our site is completely free from exploits. If a user is caught exploiting any area of ULcast.com, their account will be permanently terminated.
b. We reserve the right to modify any of the information on the site at any given time
a. Our free "AutoDJ" service enables you to upload MP3 music files to our services, and then stream the music from our services to your rented streaming server.
b. The service enables you to control the order songs play in, or optionally, play songs in a random order. Additionally, you may modify aspects of the service, such as fade time for songs. We restrict the right to remove and/or add features at any time.
a. You are only permitted to upload and stream songs that are legally in your possession.
b. We claim no responsibility whatsoever for what you choose to stream using our free "AutoDJ" service.
c. The AutoDJ server may have some upload limitations like, you cannot upload other than MP3 files and the server may have file size limitations. This cannot be changed for server security reasons.
d. You may not use our free "AutoDJ" service to distribute adult or illegal material.
e. Using our free "AutoDJ" service, you are still responsible for meeting the legal requirements for your station. This may include, but is not limited to, internet radio licensing.
a. ULcast.com will not be liable for delays or failure in performance caused by acts of God, war, terrorism, strike, labor dispute, work stoppage, fire, act of government, or any other cause, whether similar or dissimilar, beyond our control.
b. ULcast.com reserves the right to restrict, alter, or modify fees, benefits, rules, regulations, special offers, membership terms and conditions or terminate services at any time and without notice.
c. ULcast.com is not liable to keep any user data, such as songs uploaded to the service, for users that have either cancelled their service or have an inactive subscription.
a. As our "AutoDJ" service is provided as a free service, no refunds will be given for any reason in relation to this service.
